Business Entity: Houghtonville Services, llc, a Vermont Limited Liability Company (“Company,” “we,” “our,” or “us”).
These Terms and Conditions (“Terms”) govern the purchase of tickets and participation in alpaca walks, farm visits, and related activities (collectively, the “Activities”) offered by the Company at its property in Vermont (the “Farm”). By purchasing a ticket, entering the Farm, or participating in any Activity, you (“Participant,” “you,” or “your”) agree to be bound by these Terms.
1. Assumption of Risk :Participation in the Activities involves inherent risks, including but not limited to contact with animals, uneven terrain, natural outdoor hazards, slips, trips, falls, bites, kicks, scratches, allergic reactions, weather conditions, and other risks of bodily injury or death. By purchasing a ticket or entering the Farm, you knowingly and voluntarily:
- Assume all risks, known and unknown, associated with the Activities; and
- Accept full responsibility for any injury, illness, damage, or loss you may suffer, including bodily injury or death.
2. Release of Liability and Hold Harmless Agreement
To the maximum extent permitted by Vermont law, you hereby:
- Release and Discharge the Company, the property owner(s), the operators, employees, contractors, volunteers, and agents (collectively, the “Released Parties”) from any and all claims, demands, causes of action, damages, costs, or liabilities arising out of or in any way connected with your participation in the Activities, whether caused by negligence, fault, or otherwise.
- Agree Not to Sue the Released Parties for any claims related to bodily injury, property damage, or death, even if caused by the negligence or fault of the Released Parties.
- Agree to Indemnify and Hold Harmless the Released Parties from any and all claims, demands, or liabilities brought by or on behalf of you, your estate, heirs, executors, administrators, or assigns.
3. Participant Requirements
- Participants must follow all instructions provided by staff.
- Children under 16 must be accompanied by a parent or guardian.
- Participants must wear appropriate clothing and footwear suitable for outdoor and farm environments.
- The Company reserves the right to refuse participation to anyone whose behavior poses a risk to animals, staff, or other visitors.
4. Tickets, Cancellations, and Refunds
- All ticket sales are final unless otherwise stated.
- The Company reserves the right to cancel or reschedule Activities due to weather, animal welfare, or operational concerns. In such cases, participants may be offered an alternative date or credit.
5. Governing Law
These Terms shall be governed by and construed under the laws of the State of Vermont, without regard to its conflict of law provisions. Any dispute arising out of or related to these Terms shall be brought exclusively in the courts located within Vermont.
6. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
7. Acknowledgment of Understanding
By purchasing a ticket or participating in the Activities, you acknowledge that you have read, understood, and agreed to these Terms, including the waiver of liability and assumption of risk. You fully understand that you are giving up substantial legal rights, including the right to sue, and you do so freely and voluntarily.
